Town Council Regular Monthly Meeting

   
I.  OPENING OF REGULAR MEETING  
A. Call to Order and Roll Call
  All Town Council members, Town Clerk, Town Manager and our Town Clerk were present

During the January SCAT steering committee meeting, Lew Killmer was appointed as a member of the SCAT advisory group on Delaware Senate Bill 64.  Lew briefly provided an overview of the advisory group.
   
  Delmarva Power issued a refund to the Town in the amount of $80,615.78 for unspent funds used for removing overhead and installing underground service in our Garfield Parkway enhancement project.
   
 
On Saturday, February 4th 2012 at 1 PM, the Bethany Beach Police Department will be hosting a “How not to be a Victim” seminar to reduce the property crimes targeted in the Town of Bethany Beach and its surrounding neighborhoods.  The seminar, which will stress the importance of securing your residences, vehicles, personal belongings and keeping a watchful eye for suspicious vehicles and or persons, will be held at the South Coastal Library.
   
  At this time I asked that we have a moment of silence in memory, Kathleen Mink, who served as a member of our Planning Commission for many years.  Kathleen passed away at the end of December and we have truly lost a loving and kind friend.
   
  The Mayor asked if any Council Member would like to comment at this time.
   
  Public comment was requested on any subject not on the agenda.  Comments regarding agenda items are requested during the discussion of old and/or new business.

III.  OLD BUSINESS  
A.

 
(Second Reading)  An ordinance to amend Chapter 530 (Signs) Article V (Sign Permits: Application and Processing Procedures) Section 20 (b) (Temporary Permits for Special Event Signs) of the Town Code of Bethany Beach (Killmer)
  Synopsis
This ordinance allows the Town Manager to issue a Temporary Permit for Special Event Signs.
  The ordinance was approved.
   
B.
 
(Second Reading)  An Ordinance to Amend Chapter 530 (Signs) Article VIII (Nonconforming Signs, Section 28 (Existing Nonconforming Signs - Abatement) of the Town Code of Bethany Beach (Killmer)
  Synopsis
This ordinance clarifies regulations for signage as it pertains to non-conforming legal signs.
  The ordinance was approved.  
     
IV.  NEW BUSINESS
A.
 
(First Reading) An ordinance to amend Chapter 56 (Personnel Policies), Section 2 (Personnel System) of the Town Code of Bethany Beach (Dorfman)
  Synopsis
This proposed change deletes a recently passed ordinance requiring a Town Council vote and approval for any change to personnel and administrative policies.
  As this was a first reading Council generally does not vote on the issue, which would be expected to return to our agenda for discussion and possible vote during a future meeting.
     
B.
 
(First Reading)  An ordinance to amend Chapter 102 (Business Licensing) of the Bethany Beach Town Code to allow the Town to revoke a business license for non-payment of Town Fees (Killmer)
  Synopsis
This proposed change provides a mechanism for the closure of a business that is not properly licensed or has failed to pay appropriate Town fees.
  As this was a first reading Council generally does not vote on the issue, which would be expected to return to our agenda for discussion and possible vote during a future meeting.
     
C.
 
Discussion, consideration and possible vote on resolution to support the Assawoman Canal Path (Olmstead)  Resolution Approved with some modification. 
  The Delaware Department of Environmental and Natural Resources in conjunction with the Towns of Bethany Beach, Ocean View, South Bethany and private communities including Sea Colony, Salt Pond, Waters Edge, etc. have met for approximately two years while creating a concept plan for a walk, jogging, bicycle, etc. pathway along the Assawoman Canal between the north end of Ocean View and South Bethany.  The concept is now developed and the various entities have been requested to express their opinions on approval of the concept.   
     
D.

 
Discussion, consideration and possible vote on changing the Town's Schedule of fees to add administrative fees for failure to pay business license and rental license fees when payments are due.  (Killmer)  Modification approved
  Research has shown that a number of both business licenses and rental licenses are not obtained within a reasonable time of the annual license renewal date.  Due to the requirement for additional work by Town staff, it is felt a late payment fee is appropriate.
     
E.
 
Discussion, consideration and possible vote on proposal submitted by Velocitel regarding leasing space on the Collins Street water tower for an antenna  (Gordon) Proposal turned down
  This discussion has been ongoing off and on for several years and your current Town Council has been actively researching this issue.  Based on the vote to not allow the installation, our current Town Council has taken the same action taken by a previous Town Council several years ago. 
     
F.
 
Discussion, consideration and possible vote on contract submitted by Kebony to purchase advanced wood composite lumber for decking and railing on boardwalk  (Graviet)  Contract Approved
  Based on our experience with both the company and the product, which was previously installed on the north portion of our boardwalk, it was decided to continue with the same product on the balance of the boardwalk.
     
  Prior to requesting a motion for adjournment, the Mayor asked if any Council Member would like to comment.
