Town Council Regular Monthly Meeting

   
I.  OPENING OF REGULAR MEETING

Mediacom provides one-half (1/2) price seasonal rates for cable television service to their non-resident customers from November 1st to March 31st.  You may wish to call (800) 445-5562 and convert to the lower rate for the winter, if you are not here during that time period.  
   
  On October 1st, The Center for the Inland Bays honored four special awardees, one of which was the Town of Bethany Beach.  The award in the form of a horseshoe crab was presented based on the support provided by the Town as we work together at the Bethany Beach Nature Center to educate the public regarding wetlands, estuarine ecology and watershed studies a joint effort by the Town and the Center for the Inland Bays.  The award will be placed on display in our Nature Center. 
   
  Between today and October 28th is our fall bulk trash pickup time.  Bulk trash will be picked up for free during these weeks. Leave it where you normally leave your garbage, and Public Works will dispose of it at their convenience. There is no need to notify Town Hall.  Note this does not include construction material, hazardous materials, paints or explosives.
   
  Council held a public hearing this past Monday during which a representative from the Delaware Environment and Natural Resources agency made a presentation regarding the Assawoman Canal Trail Concept Plan and interested individuals provided their comments on the concept plan.
   
  Council met in a workshop/special meeting this past Monday during which we discussed the following subjects:  AT&T request to consider a proposed contract to install antennas on our water stand pipe and a building on the grounds of our water plant, proposal to amend the sign ordinance regarding non-conforming legal signs, review of Assawoman Canal Trail Concept Plan, video broadcast by the Internet of Town Council monthly meetings, review of trash and recycling schedules, and a review of the Town Council's Protocol Manual.  It is our habit to not place items on workshop/special meetings, which require a vote and no votes were taken during the meeting. 
   
  Delaware Insurance Commissioner Karen Weldin Stewart, CIR-ML, and Deputy Commissioner Gene Reed will be addressing current insurance issues at a meeting of The Canal Homeowner's Association at the South Coastal Library meeting room on Saturday, October 29 at 9:30 am.  The Commissioner was invited by The Canal Association to address issues and concerns related to recent reports of increasing insurance company policy-writing exclusions and restrictions on homes close to the coast. All interested Bethany Beach property owners are invited by the Association to attend.  Contact Rosemary Hardiman for questions:  (302) 537-4830.
   
  Beach replenishment is expected to begin in late November with 700,000+ cubic yards of sand being added to the beach and dune.  Work is currently taking place on the beach in South Bethany and upon completion, the contractor will move north and work in Bethany Beach.  The replenishment will be a 24/7 operation and if you have never observed the process, you may enjoy doing so.  We have actually seen people watching the work in the wee hours of the morning.
   
  Public comment was requested on any subject not on the agenda.  Comments regarding agenda items are requested during the discussion of old and/or new business.

IV. NEW BUSINESS  
 A.

 
(First Reading)  An ordinance to amend the recently adopted ordinance regulating the parking and placement of recreational vehicles and portable on demand storage units to eliminate the reference to PODSŪ in the ordinance.  (Killmer)
  Pursuant to Section 45-5 of the Town Code, Council agreed to waive the first reading rule for this ordinance and voted unanimously to amend the ordinance as the changes were simply words in place of the word "PODSŪ".

Discussion, consideration and possible vote on Committee Guidelines and Standing Committees (McClenny)
  The Committee Guidelines were, several modifications were agreed to and approved for use.
     
 C.
 
Discussion, consideration and possible vote on Planning Commission and Board of Adjustment Appointments.  (McClenny)
 
The Mayor made the following appointments and Council confirmed same.
Planning Commission:
Lew Killmer Term expires 10-18-2012  
Fulton Lapatto Term expires 10-16-2014  
Chuck Peterson Term expires 10-16-2014  
   
  Board of Adjustment:
  Len Kidwell Term expires 10-16-2014  
   
 D. Discussion, consideration and possible vote on Committee Chair Appointments  (McClenny)
 
The Mayor made the following one year appointments and Council confirmed same:

Discussion, consideration and possible vote on entering into an Agreement with the Coastal Point Newspaper to sponsor future candidate's forums  (Olmstead)
  After discussion, Council approved the continued candidate forums with the Coastal Point Newspaper as moderator.
     
  F.
 
Discussion, consideration and possible vote on the working groups final draft (as prepared by our attorney) of the Mediacom Franchise Agreement  (Gordon)
  After discussion, Council approved the agreement.  Four local municipalities (Bethany Beach, Millville, Ocean View and South Bethany), with the assistance of our attorney, developed the agreement during the last several months.  Ocean View's Town Council has also approved the agreement and the other municipalities will vote on the agreement in the near future.

Discussion, consideration and possible vote on mailing a letter to all Bethany Beach property owners regarding the proposed Assawoman Canal Trail Concept Plan  (Gordon)
  After discussion, Council approved an informational mailing in order to assure that all our property owners are aware of the plan. 
     
 H.
 
Discussion, consideration and possible vote on a contract submitted by East Coast Underground to install nineteen (19) streetlight pole bases for the amount of $60,800  (Graviet)
  After discussion, Council approved the contract - this will provide for the installation the necessary bases for new street lights along Garfield Parkway from Route 1 to the bandstand.
