I.  OPENING OF REGULAR MEETING

Call to Order and Roll Call
 
All Council members except Ms. Olmstead were present as were the Town Manager, Town Clerk and Town Solicitor.  Ms. Olmstead was out of state.

  The annual Town Council election will be held on Saturday, September 12, 2009 here in Town Hall from 12 to 6 p.m.
       
  Anyone wishing to file as a candidate for the election must file an Application for Candidacy at Town Hall no later than 4:00 p.m. on July 28, 2009.
       
  Prior to our Town Council meeting this evening we held a public meeting regarding the proposal by Bluewater Wind to tunnel below Garfield Parkway and Kent Avenue and install a 230KV power line, which would carry electricity from their proposed off shore windmill complexes to the Delmarva Power facility located on Kent Avenue from which it would continue via a power line right of way to the Indian River Power Plant. 
   
 

In August, 2007 we began the pursuit of a grant opportunity, which would provide our Town with amateur (ham) radio equipment for use during an emergency.  The equipment was received last week and will be installed in the very near future.  We have three ham radio operators who are year round residents and others who are here from time to time.  We are in the process of working with the Amateur Radio Emergency Service (ARES) and the Sussex Amateur Radio Association to be able to provide area wide coverage between the town, hospitals, shelters, Sussex and Delaware state emergency facilities, etc.

   
  Councilmember Robert “Bob” Parsons announced he will not seek re-election when his term expires in September.

(Second Reading)  An Ordinance to Add a New Chapter 144 Entitled “Geothermal Closed Loop Heat Exchange Well Systems” to the Town Code of the Town of Bethany Beach.  (Killmer)

 
 

Synopsis
This Ordinance adds a new Chapter 144 to the Town Code of the Town of Bethany Beach for the purpose of regulating the design, installation, construction, and placement of Geothermal Closed Loop Heat Exchange Well Systems (GCLs) within the Town limits.  This Ordinance also implements regulations for permit requirements for installation and construction of GCLs as well as system maintenance requirements.
