Greetings from Bethany Beach! 

Our Town Council held its monthly meeting on Friday, June 20, 2008 at 7:30 p.m. in Town Hall.  Some of the agenda items are shown below.

The upcoming Election of Town Council members was set to be held on September 6, 2008 from noon to 6 p.m. in Town Hall.  Anyone wishing to be a candidate must file an Application for Candidacy at Town Hall no later than 4:00 p.m. on Tuesday, July 22, 2008.  If you are a Bethany Beach property owner, you are pre-registered to vote. 

My July e-mail report for the Town Council meeting that will be held on Friday, July 18th will be delayed for a couple of days in order that I may be able to report on the candidates seeking election.  That e-mail report will be sent on Tuesday, July 22, 2008 after 4:00 p.m. so you will be advised of the candidates seeking election just as soon as possible. 

 Many friends and neighbors have inquired as to whether or not I am willing to serve for an additional term on our Town Council.  Having thought about the time and energy required and having discussed this issue with my wife, I have decided that I shall be seeking re-election this year.  I have enjoyed serving as a Town Council member for the past four years and have gained valuable knowledge while holding the office of both Secretary-Treasurer and Vice Mayor. 

 Once the candidates are known (July 22nd), each candidate will be invited to place their candidacy information on:  http://www.bethany-beach.net so you can read about each person before making your voting decision. 

 
New business items discussed during the May meeting included:

 A.  Consider Proposed Amendment to the Town’s Subdivision Ordinance to Amend Section 200-41 (“Streets”) of the Bethany Beach Town Code (McClenny)  Passed

Synopsis 

This ordinance amends the Bethany Beach Subdivision Code by deleting the current section addressing dead-ends and cul-de-sacs and replacing said section with a new section 200-41 addressing the same issues.  The new

§ 200-41.G outlines design guidelines; minimum and maximum dimensions for inclusion of a dead-end street or cul-de-sac in a plan; and permits a “turn-around” as an alternative to a dead-end or  cul-de-sac, including an illustration of an appropriate “turn-around” design.
 

B.  Consider Proposed Amendment to Chapter 245, Article V (“Non-Conforming Uses and Structures”) of the Bethany Beach Zoning Code by Deleting the Current Chapter 245, Article V in its Entirety and Replacing it with a New Chapter 245, Article V (“Non- Conforming Uses and Structures”)  (Possible Committee Appointment)  (McClenny)  Amended and Passed

Synopsis

This ordinance amends the Bethany Beach Zoning Code by deleting the current Article V Nonconforming Uses and Structures and replacing said article with a new Article V Nonconforming Uses, Structures and Lots.  The new Article V outlines the legislative intent of the Nonconforming Uses, Structures and Lots ordinance; outlines permitted continuation of nonconforming uses, lots and structures; clarifies legal nonconforming lots or record; discusses change of use; discusses abandonment of a nonconforming use; and outlines permitted repairs, alteration, and replacement of nonconforming structures.
 

C.  Proposed Amendment to the “Official Zoning Map of the Town of Bethany Beach” by Deleting the Current Zoning Map and Replacing it with a New “Official Zoning Map of the Town of Bethany Beach”.  This map includes the following districts:  Passed

R-1 (Residential District);
R-1A (Boardwalk Residential District);
R-1 B (Sea Villas Residential)
R-2 (Residential District);
C-1 (Central Commercial District);
C-2 (Neighborhood Commercial District); and
MORE – (Municipal, Open Space, Recreational Facilities, and Educational Zoning District)

D.   Consider Appointments to the Alderman’s Court  (Olmstead)  Passed


   E.   Consider Sending a Letter Describing How to Vote to All Eligible Voters in 2008 and Preparation of
      an Ordinance that Requires the Town to do so in future years.(Mulligan)  Passed Resolution to mail
      letter in 2008, 2009 & 2010
 

F.   Consider Contract Submitted by Penske GMC Commercial Trucks for the Purchase of a 2008 GMC Sierra 2500 HD Utility Body Work Truck for the amount of $28,474.00  (Graviet)  Passed

 

G.   Consider Contract submitted by Envirotech Environmental Control Consulting, Inc. for Continuation of Phragmites Control for the amount of $12,499.92  (Graviet)  Passed 

The Town of Bethany began ground fog spraying for adult mosquitoes (weather permitting) on Friday morning June 13th.  Ground fog applications will continue on Friday mornings between the hours of 3AM and 7AM.throughout the summer as needed.

Correction – In a previous e-mail I provided incorrect information regarding ownership of the beach.  My friend and our Delaware Senator, George Bunting, called to “…make it real clear…” that the State does not own the beach.  The beachfront property owners apparently own the property up to the high tide line.  The beach is regulated by the state via DENREC.  Thank you Senator Bunting.
